Madhya Pradesh’s cabinet approves Uniform Civil Code bill, aiming for gender equality by standardizing civil laws, criminalizing triple talaq, and mandating marriage/live-in relationship registration.

The Madhya Pradesh cabinet has formally approved a draft Uniform Civil Code (UCC) bill, an initiative poised to introduce a standardized civil law framework across all communities within the state. This legislative action marks a pivotal structural change, aiming to dismantle disparities embedded within various personal laws by criminalizing practices such as triple talaq and ‘nikah halala’, alongside prohibiting polygamy outright.

A core mechanism of this proposed legislation is the mandated registration of all marriages, divorces, and even live-in relationships. The bill stipulates a three-month imprisonment penalty for failing to register live-in relationships within one month, underscoring a clear intent to bring these social arrangements under formal legal purview and ensure accountability.

The UCC draft establishes a robust framework for achieving legal equity, particularly for women and children. It guarantees equal legal rights for all children, irrespective of their biological origin, adoption, or birth via surrogacy or assisted reproductive technology (ART). Furthermore, children born from live-in relationships will attain full legal status, and abandoned female partners in such relationships will be empowered to claim maintenance through the courts, mirroring the rights of a legal wife.

Chief Minister Mohan Yadav articulated the state’s first principles behind this enactment, characterizing the UCC as a historic stride towards realizing equality, equity, justice, and secularism. He emphasized its primary objective: to systematically eliminate long-standing discrimination against women under existing personal laws and to ensure their comprehensive empowerment. The bill, meticulously prepared by the Justice Ranjana Desai (retired) committee, also establishes a uniform, gender-neutral succession framework, granting sons and daughters identical property inheritance rights and ensuring equitable treatment for widows and widowers concerning the deceased’s estate.

This legislative development in Madhya Pradesh is not an isolated event but rather indicative of a broader pattern of legal reform observed across India. The state’s UCC has been formulated following an in-depth study and drawing guidance from similar Uniform Civil Codes adopted by Uttarakhand in 2024, Gujarat in 2026, and Assam in 2026. This inter-state referencing highlights a growing trend towards harmonizing civil statutes, though the bill notably exempts Scheduled Tribes from its provisions, respecting existing constitutional safeguards.

The move represents a significant structural reorientation of civil jurisprudence in Madhya Pradesh. By standardizing laws around marriage, divorce, inheritance, and maintenance, the bill seeks to establish a singular legal identity for all citizens, moving beyond the complexities and often discriminatory outcomes of diverse personal laws. This shift, while specific in its immediate application, reflects a larger national discourse on legal uniformity and gender justice.
