The Supreme Court has instructed the government to investigate allegations that private verification entities are accessing and commercially utilising sensitive employment and financial data. This directive comes amidst concerns over potential misuse of information linked to Income Tax Returns (ITR) and Employees’ Provident Fund Organisation (EPFO) records.
The court was reviewing a Public Interest Litigation (PIL) that highlighted the emergence of a “commercial technological ecosystem” centered on verifying personal information. While the court did not identify any specific company illegally accessing records, it underscored the need for scrutiny into how private firms might be using such data.
Understanding the Supreme Court’s Stance
The Supreme Court voiced its apprehension regarding the alleged misuse of personal information by private entities and urged the government to thoroughly examine the situation. Reports from the hearing indicate the court suggested the government, with the help of domain experts, consider developing an “antidote” to this issue.
It further directed the government and relevant authorities to review the petitioner’s representations and implement necessary actions, ideally within four months. Importantly, the court did not declare that private companies have free access to ITR or EPFO records, nor did it confirm any data breach.
Allegations of Commercial Exploitation
The PIL specifically alleged that private verification entities were either accessing or commercially exploiting statutory employment and financial data. This includes information tied to EPFO/UAN records and PAN-linked financial details.
The petitioner pointed to private services reportedly advertising or offering access to various data types, raising questions about consent and safeguards. Such services allegedly include:
- EPFO passbook data
- Form 26AS data
- Income-tax-return information
These are currently allegations presented before the court and have not been judicially confirmed as facts. The government’s upcoming examination will therefore be crucial in determining the veracity of these claims, how any such access might occur, and whether existing safeguards are sufficient.
