The Competition Commission of India (CCI) is strategically reducing suo motu investigations to avoid conflicts of interest and streamline regulatory oversight, as revealed to a Parliamentary panel.

The Competition Commission of India (CCI) is actively reducing its initiation of suo motu, or on its own motion, cases to prevent potential conflicts of interest. This policy shift was communicated to a Parliamentary panel, which had observed a decline in such investigations.

Understanding CCI’s Policy Shift

CCI Chairperson Ravneet Kaur explained that a key reason for this change is to avoid the commission both establishing and adjudicating the same cases. Suo motu cases were more frequent previously, especially when public awareness regarding competition law remained low.

The CCI also now shows restraint in initiating probes within sectors already overseen by established sectoral regulators. This approach ensures a clear division of regulatory responsibilities and avoids duplication.

Anti-Trust Case Resolution

The Competition Commission of India has successfully resolved 1,237 out of the 1,375 anti-trust cases it has received. This demonstrates the commission’s consistent efforts in competition enforcement across various sectors.

The Android Smart TV Settlement

In a notable instance, a settlement amount of Rs 20.24 crore was imposed in a case involving Android Smart TVs. This figure was determined by considering the company’s relevant Indian turnover, along with mitigating and aggravating factors.

The calculation also incorporated a 15% statutory settlement discount, influencing the final amount. These factors collectively shaped the financial penalty imposed by the CCI.

Kaur clarified that this Indian case is not directly comparable to a European Union fine of USD 4 billion in a similar matter. The EU case specifically involved mobile operating systems, which is distinct from the Indian Smart TV market issue.

Google had previously settled this Android Smart TV case with the CCI in April of the previous year. As part of the resolution, Google agreed to modify its vendor agreements.
