TDS Framework for Shareholders

Under the Income Tax Act, 2025, as amended by the Finance Act, 2026, dividends are now taxable for shareholders, necessitating tax deduction by Sportking India. Specific rates apply based on residency and documentation.

  • Resident Shareholders: A 10% TDS will apply with a valid Permanent Account Number (PAN) under Section 393(1).
  • Missing/Inoperative PAN: The deduction rate increases to 20% under Section 397(2).
  • Exemptions for Residents: Individuals may avoid TDS if their total dividend income from the company in FY27 is below ₹10,000 or if they submit Form 121.
  • Non-Individual Exemptions: Insurance companies and mutual funds can claim exemption by providing self-declarations and relevant registration certificates.

Non-resident shareholders face a 20% withholding tax, plus applicable surcharge and cess, under Section 393(2). However, benefits under a Double Tax Avoidance Agreement (DTAA) can be claimed through specific document submission.

  • DTAA Requirements: Non-residents must provide a self-attested PAN card copy, a Tax Residency Certificate (TRC) for FY27, online-filed Form 41, and a self-declaration confirming beneficial ownership and treaty eligibility.
  • FII/FPI Documentation: Foreign Institutional Investors (FIIs) and Foreign Portfolio Investors (FPIs) must additionally submit their SEBI registration certificates.

All required documents, including PAN details, bank mandates, and exemption certificates, must be submitted by August 31, 2026. The record date for determining dividend eligibility is set for September 5, 2026, with electronic payments to follow for eligible shareholders.
