Jharkhand High Court grants interim relief, staying cancellations of appointments for 11th & 13th JPSC exam selections, including Food Safety Officers.
The Jharkhand High Court has temporarily stayed the cancellation of appointments for government employees, including food safety officers, selected through the 11th and 13th Jharkhand Public Service Commission (JPSC) examinations.
Justice Deepak Roshan issued this interim order in response to multiple petitions challenging the state government’s notifications that had previously annulled these selections.
Key Developments in the Case
- Approximately 450 candidates received relief, including 54 Food Safety Officers.
- The state government had cancelled 22 examinations on August 18.
- This cancellation followed a 25-day student agitation over alleged recruitment irregularities.
This judicial intervention ensures that petitioners and other employees adversely affected by the government’s August 18 notification will continue in their respective offices for now.
The court has directed the state government to furnish its official reply by September 15, which marks the next scheduled hearing date for this ongoing matter.
Understanding the Court’s Decision
Petitioners’ advocate Amritansh Vats noted that the court’s prima facie observation indicated a violation of the principle of natural justice in the government’s cancellation notifications.
This principle generally requires that individuals be given fair notice and an opportunity to be heard before decisions are made that affect their rights or interests.
The High Court, however, made it unequivocally clear that any candidate found to have engaged in ‘foul play’ during the subsequent investigation will face severe consequences, including the termination of their service.
The final appointment status of all candidates will remain contingent upon the conclusive outcome of the ongoing investigation and the court’s ultimate judgment in this case.
