SEBI Eases KYC for Overseas Indians & Foreign Nationals

The Securities and Exchange Board of India (SEBI) has introduced a proposal to simplify the Know Your Client (KYC) procedure for individuals living outside India. This significant change targets Persons Resident Outside India (PROIs), including Non-Resident Indians (NRIs), Overseas Citizens of India (OCIs), and foreign nationals.
Streamlining Digital Onboarding for PROIs
The core of SEBI’s proposal is to enable these individual PROI clients, particularly those from countries adhering to Financial Action Task Force (FATF) standards, to complete their digital onboarding remotely. This eliminates the current mandatory requirement for their physical presence in India.
Under the new framework, intermediaries would gain the ability to accept KYC records and other essential documents digitally. This marks a departure from the existing system, which currently stipulates a client’s physical presence for digital onboarding processes.
Understanding the Current KYC Mandate
Currently, the KYC framework in India requires clients to be physically present within the country to complete their digital onboarding. This stipulation has posed challenges for individuals residing abroad who wish to engage with Indian financial markets.
SEBI’s aim is to remove this specific requirement for PROI clients, provided they are situated in nations compliant with FATF standards. This targeted approach seeks to balance regulatory diligence with ease of access for international participants.
