India’s Insolvency and Bankruptcy Code (IBC) continues to face significant delays in its resolution processes, with nearly three-fourths of ongoing cases exceeding the 270-day mark. Despite these persistent challenges, financial creditors achieved improved recoveries during the April-June quarter, according to a CareEdge Ratings report.

Understanding Persistent Delays in IBC

The average resolution time under the IBC has stretched to 757 days, while liquidation cases also face considerable delays. These prolonged timelines are primarily attributed to a combination of factors:

  • Average resolution time for Corporate Insolvency Resolution Processes (CIRPs): 757 days.
  • Average time for liquidation cases: 540 days.
  • Nearly 70% of liquidation cases have been pending for over two years.

These delays stem from aging cases, extensive litigation, and various procedural bottlenecks that collectively hinder efficient recovery efforts for stressed assets.

Tracking Improved Recovery Trends

Despite the extended timelines, the April-June quarter showed a sequential improvement in recoveries for financial creditors. This period saw a notable increase in the percentage of admitted claims successfully recovered:

  • Recovery rate for financial creditors in the April-June quarter: 28.6%.
  • Recovery rate in the preceding January-March quarter: 22.8%.
  • Amount recovered by financial creditors in April-June: Rs. 3,557 crore.
  • Total admitted claims in April-June: Rs. 12,443 crore.

Cumulatively, creditors have recovered a substantial Rs. 4.35 lakh crore, representing 30.5% of the total admitted claims to date.

Resolution Outcomes Outperform Liquidation

CareEdge Ratings highlights that while these recovery percentages might seem modest, the outcomes are considerably superior when compared to the liquidation value of the assets. This underscores the value-accretive nature of resolution-led processes over liquidation:

  • Recoveries in the June quarter relative to liquidation value: 136.7%.
  • Cumulative recoveries to date relative to liquidation value: 166.6%.

The actual realization percentage could potentially be even higher, as resolutions for older cases often incorporate accrued interest and other receivables. These additional amounts can significantly exceed the original principal outstanding and overdue sums.

Key Sectors Driving IBC Admissions

A significant proportion of cases admitted under the IBC originate from specific economic sectors. This concentration points to particular vulnerabilities within these industries:

  • Manufacturing: A key sector contributing to IBC cases.
  • Real Estate: Another sector with a high number of insolvency proceedings.
  • Construction: Also heavily represented in IBC admissions.

These sectors typically exhibit elevated exposure to financial leverage, unpredictable cash flows, inherent project execution risks, and fluctuating cyclical demand conditions, contributing to their higher incidence of stressed assets.
